General Terms and Conditions

 

These general terms and conditions govern the use of the badasswear.fi online store and all agreements between badasswear.fi (hereinafter referred to as the "Online Store" or "Badasswear") and its customers (hereinafter referred to as the "Customer" or "You"). By using the Online Store and/or placing an order, the Customer agrees to comply with these terms and conditions.

 

1. The Online Store and the Seller

 

The maintainer and seller of the Online Store is BigFlash ry, business ID 2404618-5; Sairaalakatu 3 B4 70100 Kuopio bigflash78@gmail.com.

 

2. Products and Prices

 

  • The products sold in the Online Store are clothing and accessories designed and sold by Badasswear.

  • Product prices are stated in euros (€) and include Value Added Tax (VAT), unless otherwise specifically mentioned.

  • Prices do not include delivery costs, which are added to the total sum of the order when selecting the delivery method.

  • Badasswear reserves the right to change product prices and selection without prior notice.

  • Product images in the Online Store may slightly differ from the actual product, for example, in terms of colors.

 

3. Ordering

 

  • Placing an order in the Online Store requires the Customer to have read and accepted these terms and conditions.

  • The Customer can place an order by adding the desired products to the shopping cart and proceeding to checkout.

  • When placing an order, the Customer must provide the necessary information, such as name, address, email address, and telephone number. The Customer is responsible for the correctness of the information provided.

  • The order becomes valid when the Customer has confirmed the order and paid for it according to the payment methods offered by the Online Store.

  • Badasswear will send the Customer an order confirmation via email, confirming the ordered products, prices, and delivery costs.

 

4. Payment

 

  • The Online Store accepts [list accepted payment methods, e.g., Klarna online banking payments, credit cards, MobilePay, invoice/installment].

  • The payment transaction is carried out in the secure payment environment of the chosen payment service provider.

  • Badasswear does not have access to the Customer's bank or credit card information.

 

5. Delivery

 

  • Badasswear delivers products to [list delivery areas, e.g., Finland].

  • Delivery costs are determined by the chosen delivery method and the size/weight of the order. The valid delivery costs are visible on the Online Store's delivery information page and at checkout before the order is confirmed.

  • The estimated delivery time is indicated in the Online Store and in the order confirmation. Badasswear strives to deliver orders as quickly as possible but is not responsible for delays caused by force majeure.

  • The Customer is responsible for receiving the order at the specified delivery address.

 

6. Returns and Exchanges

 

  • The Customer has a 14-day right of withdrawal in accordance with Finnish consumer protection law. The withdrawal period begins upon receipt of the product.

  • To cancel an order, the Customer must notify Badasswear clearly (e.g., by email or via a return form, if available) before the withdrawal period expires.

  • Returned products must be unused, in their original condition, and in their original packaging with any tags.

  • The Customer is responsible for return costs, unless the return is due to an error by Badasswear (e.g., incorrect or defective product).

  • Refunds for returned products will be made to the payment method provided by the Customer without delay and no later than 14 days after the receipt of the notice of withdrawal and the returned products' arrival and inspection by Badasswear.

  • Products have a right to exchange [state the terms and duration of the right to exchange]. Exchanges generally concern a different size or color of the same product, subject to availability.

 

7. Complaints

 

  • If the Customer notices a defect or deficiency in the product, the Customer must notify Badasswear as soon as possible after noticing the defect.

  • The complaint must be made in writing (e.g., by email) and should describe the defect or deficiency as accurately as possible.

  • Badasswear will handle complaints on a case-by-case basis in accordance with applicable legislation.

  • In approved complaint cases, Badasswear will primarily seek to correct the defect or supply a non-defective product. If this is not possible, the Customer will be refunded the price of the product and any delivery costs.

 

8. Intellectual Property Rights

 

  • All content of the Online Store, including texts, images, logos, product names, and other material, is the property of Badasswear or its partners and is protected by copyright law and other intellectual property rights.

  • Copying, distributing, or other commercial use of the Online Store's content without Badasswear's prior written permission is prohibited.

 

9. Processing of Personal Data

 

  • Badasswear processes Customer's personal data in accordance with current data protection legislation. The data is primarily used for order processing, delivery, and customer service.

10. Cookies

 

  • The Online Store uses cookies to improve user experience and the functionality of the Online Store.

11. Applicable Law and Dispute Resolution

 

  • These terms and conditions are governed by the laws of Finland.

  • Any disputes will primarily be attempted to be resolved through negotiation.

  • If negotiations do not lead to a resolution, the Customer can submit the matter to the Consumer Disputes Board (www.kuluttajariita.fi) for resolution.

  • The Customer also has the right to bring an action in the general district court of their domicile or the district court of [Seller's domicile].

 

12. Changes to the Terms and Conditions

 

  • Badasswear has the right to change these terms and conditions. Changes will take effect when they are published in the Online Store.

  • The Customer is recommended to review the current terms and conditions before ordering.
